Terms and Conditions
1. Our contract
All bookings are made with Bespoke Driven Tours (ABN 22 514 384 089). By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.
Dates and itineraries are valid from 1st July 2021 to 1st July 2022. Beyond 1st July 2022 dates and itineraries are indicative only and may be subject to change.
3. Deposit requirement
You are required to pay a non-refundable deposit of 50% of the trip total for your booking to be confirmed. If your booking is made within seven days of the departure date then the full amount is payable at the time of booking.
4. Acceptance of booking and final payments
If we accept your booking we will issue a confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or if you book within seven days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due seven days before the trip date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled.
5. Prices & surcharges
Our trip prices are set prices except for private hire trips that are quoted as per your requirements. If you wish to cancel your booking to take advantage of a cheaper price elsewhere, full cancellation conditions apply. The most up to date pricing is available on our website.
6. Your details
In order for us to confirm your booking you must provide all requested details with the balance of the booking price. Necessary details required are full name, address, mobile number and email address.
7. Cancellation by the traveller
If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:
• seven days or more prior to departure, we will hold the deposit for credit (for a six month period) • seven days or fewer prior to departure, we will retain 50% of monies paid and hold 50% in credit (for a six month period); • If you have flu/COVID conditions, supported by a medical certificate, we will hold 100% of monies paid for credit (for a six month period)
You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to be available for pick up on a trip or leave it prior to its completion, no refund will be made.
8. Cancellation by us
We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary.
If we cancel your trip due to reasons other than a force majeure event you will receive a full refund.
If we cancel your trip due to a force majeure event you will receive 100% credit to use for a future trip or a refund less unrecoverable costs.
9. Booking amendments
If you wish to transfer your booking to a third party you must notify us at least seven days prior to the proposed departure date. No fees will apply. If you notify us less than seven days prior to the booking date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip.
The price of your trip includes:
• Tastings/lunches as outlined in the package you have chosen• person transport to all venues• sightseeing and meals as listed in the Essential Trip Information• the services of a tour operator to guide you throughout the course of your booking.
The land price of your trip does not include:
• additional merchandise/gifts/food purchased aside from the package inclusions • additional wines/tastings above and beyond the package inclusions • additional venues beyond package inclusions..
12. Age of passengers
Minimum age of passengers is age 18 and above. Bespoke Driven Tours provides primarily winery tours for adults only. We do not cater for persons under the age of 18.
13. Small groups & combination trips
At times we can have multiple groups or couples travelling on the same tour. Our maximum capacity if passengers is seven adults. If you would like to know how many people are booked on your trip please ask prior to making your booking.
14. Valid ID
You must carry a valid ID with you in order for us to keep accurate records for COVID-safe operations and contact tracing purposes. You will be required to use our own QR code at the start of your trip, and observe sign-in requirements of all venues visited.
15. Travel insurance
Travel insurance is strongly recommended to all travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation .
17. Change of itinerary
While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary. Before departure: If we make a major change we will inform you as soon as reasonably possible if there is time before departure. We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.
18. Authority on tour
Your Bespoke Driven Tours driver for the day is an accredited driver. The decision of your driver is final on all matters likely to affect the safety or well-being of any traveller. If you fail to comply with a decision made by your driver, or interfere with the well-being or mobility of the group, your driver may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the local laws, rules and regulations of all venues visited, and you also agree to travel in accordance with our responsible travel guidelines.
Should any passengers become argumentative or abusive towards the driver or other passengers on any day tour, Bespoke will exercise its right to exclude you from further travel and you will be left at the venue or dropped at the nearest public transport/taxi stop. No refund will be forthcoming.
In the event that a passenger causes damage or is sick in the vehicle requiring professional cleaning and/or the vehicle being out of service, the full cost of the clean will be passed on to the passenger. By booking a tour with Bespoke Driven Tours, you agree to accept this cost should an incident of this nature occur.
20. Limitation of liability
To the fullest extent permitted by law:- any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded;- you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and- any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded. To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
21. Optional activities
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your driver in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider and may be negotiated on the day.
22. Claims & complaints
If you have a complaint about your trip please inform your Bespoke Driven Tours driver at the time, in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
24. Photos and marketing
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes. Please let us know at the time of booking if permission is not granted and we will honour and respect your right to privacy.
26. Applicable law
The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia

PERSONAL INFORMATION WE COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. We refer to this information as “Order Information.”
HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
Communicate with you;
Screen our orders for potential risk or fraud; and
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above. Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. DO NOT TRACK
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
If you are an Australian resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.
Additionally, if you are an Australian resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Australia.
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Minimum age for Bespoke Driven Tours passengers is 18 years.
The Site is not intended for individuals under the age of 18 years. Our services are for adults only.
